All content, features, and functionality of Wibigo are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

To the maximum extent permitted by law, Wibigo shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.

We may terminate or suspend your account and access to the service immediately, without prior notice, for any breach of these Terms of Service.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes. Continued use of the service after changes constitutes acceptance of the new terms.

The service is operated by Wibigo OÜ, a company registered in Estonia. These Terms of Service shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions.

15. Data Processing (GDPR Article 28)

This section applies whenever you connect a third-party sales channel — such as Shopify, Etsy or Meta — and personal data about your customers therefore passes through Wibigo. For that data you are the data controller and Wibigo OÜ is the processor. It forms the data processing agreement required by Article 28 of the GDPR; no separate signature is needed.

Subject matter and purpose. We process your customers' personal data only to provide the features you switched on: importing your catalogue, showing your orders in your Wibigo dashboard, and keeping stock and prices in step with the channel you connected. We act only on your documented instructions, which are the settings you choose in the product.

Categories of data and data subjects. Data subjects are your customers and prospective customers. Categories are limited to what the connected channel sends for an order: name, email address, phone number, delivery address, order contents and totals. We do not receive or store payment card numbers.

Duration. For as long as the connection is active and your account exists. Disconnecting the channel or deleting your account deletes the data held for it; backups are rotated automatically and expire within 30 days.

Confidentiality and security. Personnel with access are bound by confidentiality. Access tokens are encrypted at rest, all traffic is served over TLS, and access to production data is limited to the people who need it.

Sub-processors. You give us general authorisation to engage the sub-processors listed at wibigo.com/sub-processors, each bound by contract to process data only on our instructions and to protect it to the standard set out here. That page names every provider, what it is used for and where it processes data; it is kept current. We will inform you before adding or replacing a sub-processor that handles your customers' data, and you may object — if we cannot resolve the objection, you may terminate the affected connection.

International transfers. Processing takes place primarily inside the European Economic Area. Where a sub-processor operates outside it, the transfer is covered by the European Commission's Standard Contractual Clauses or another approved safeguard.

Assistance and audit. We help you respond to data subject requests and to personal data breaches, and we notify you without undue delay after becoming aware of a breach affecting your customers' data. On request we make available all information necessary to demonstrate compliance with this section, and we allow for and contribute to audits, including inspections, conducted by you or an auditor you appoint. Audits are arranged with reasonable notice, no more than once a year unless a breach or a supervisory authority requires otherwise, and must not compromise the confidentiality of other customers' data.

Unlawful instructions. We act only on your instructions. If we consider an instruction to infringe the GDPR or other applicable data protection law, we will tell you immediately and may suspend that instruction until it is resolved.

Deletion and return. On termination we delete your customers' personal data, unless retention is required by law. You can export your data from the product before you leave, or ask us at privacy@wibigo.com.

Marketing to your customers. Contacts created from a connected channel's orders appear in your Wibigo CRM so that you can serve those customers. You remain responsible for having a lawful basis before sending them marketing — consent where the law requires it. Wibigo never markets to your customers on its own initiative; bulk e-mail leaves only when you send it. Messages about an order the customer actually placed — confirmations, delivery updates — rest on your contract with that customer, not on marketing consent, and are sent as part of the service.
